Privacy

Short version: we don't collect anything about you. No account, no sign up, no tracking, no ads, no analytics.

Who is responsible

The controller for any personal data is STUDIO MERLIN, s.p., with the contact details in the legal notice above.

What happens in your browser

• All the sounds and all the painting are made on your own device. Nothing you play or paint is sent to us.
• So your wall is still there next time, your browser keeps a picture of it in its local storage on your device. We can't see it. Tap Clean, or clear this site's data in your browser, to delete it.
• When you save your art, the picture is made on your device and goes straight to your downloads or the share menu you pick. We never receive it.
• We use no cookies. Fonts and all other files come from our own server, so no other company is contacted when you visit.

What our server sees

Like every website, our server needs your IP address to send the page to your device. We have switched off visitor logs for SPLAT KIT, so we don't keep a list of visits. If something breaks, a technical error message may briefly contain an IP address. These messages are kept only for security and fixing errors (our legitimate interest, Article 6(1)(f) GDPR) and are deleted automatically within a few weeks.

The site is hosted by Hostinger on a server in the European Union, under a data processing agreement. Your data is not sold, shared for advertising or sent outside the EU by us.

Links to other sites

The small Tassh logo links to bytassh.com. If you follow a link to another site, that site's own privacy rules apply.

Your rights

Under the GDPR you can ask to see, correct or delete personal data about you, ask us to limit or stop using it, and object to how we use it. Because we don't keep data that identifies you, there is usually nothing for us to find, but write to us anytime. You can also complain to the Slovenian data protection authority, the Information Commissioner (Informacijski pooblaščenec, www.ip-rs.si), or to the authority where you live.

Kids

SPLAT KIT is fine for all ages and doesn't ask for any personal information.

Terms of use

By opening or using SPLAT KIT you agree to these terms. If you don't agree, please don't use it.

1. What SPLAT KIT is

SPLAT KIT is a free entertainment toy for making noise and splat pictures. It is not a musical instrument, a professional tool or a storage service. There is no account and nothing to buy.

2. Payments and refunds

SPLAT KIT is free, so there is nothing to pay and nothing to refund. If paid digital extras are ever offered, they will be digital content delivered right away. In that case you agree, before paying, that delivery starts immediately and that you lose the 14 day right of withdrawal once it starts (Article 16(m) of EU Directive 2011/83/EU). Payments for digital content are then final and not refunded, except where the law requires it, for example if the content does not work at all and we can't fix it.

3. Provided "as is"

SPLAT KIT is provided "as is" and "as available", without any promise or warranty of any kind, express or implied, including that it is fit for a particular purpose, accurate, error free, secure, compatible with your device, or always online. We may change, pause or remove any part of it, or the whole app, at any time and without notice.

4. Your responsibility

• You use SPLAT KIT at your own risk and choice.
• You are responsible for your device, your volume and your surroundings, and for anything you create, save, download, share or publish with it.
• You are responsible for any information, words or files you enter or use. We are not responsible for wrong, incomplete or misleading information that you or other people enter, or for what happens because of it.
• Your wall is stored only in your browser. It can disappear at any time (for example when the browser clears its data). Save the art you want to keep. We can't recover it.
• Don't misuse SPLAT KIT: no attacks, overloading, scraping, hacking, copying the app, or using it for anything illegal or harmful to others.

5. Health and safety

Some sounds are sudden and loud. Start at a low volume, especially with headphones; loud sound can damage hearing. The screen has fast moving effects. If you are sensitive to flashing or motion, or have epilepsy, don't use it or turn on reduced motion in your device settings. Children should use it with an adult nearby.

6. Limitation of liability

To the fullest extent allowed by law, STUDIO MERLIN, s.p. and its owner are not liable for any damage or loss arising from SPLAT KIT or its use, including errors, bugs, wrong results, interruptions, downtime, lost or deleted artwork or data, device problems, lost profits, or any indirect, incidental or consequential damage. Where liability can't be fully excluded, it is limited to the amount you paid us for SPLAT KIT in the last 12 months, which for the free app is zero euro.

None of this limits liability that the law does not allow to be limited, such as for intent, gross negligence, or injury to life, body or health, and it does not take away rights you have as a consumer under the mandatory law of the country where you live.

7. Indemnity

If you break these terms or the law while using SPLAT KIT, and someone makes a claim against us because of it, you agree to cover our resulting costs and damages, including reasonable legal costs, as far as the law allows.

8. Ownership

Pictures and beats you make belong to you. The SPLAT KIT name, drawings, sounds, code and design belong to STUDIO MERLIN, s.p. and may not be copied, resold or passed off as your own. Fonts are used under their open font licences.

9. Complaints first

If something is wrong, write to us first at tassh@studio-merlin.com and give us at least 30 days to sort it out before taking any other step.

10. Law and courts

These terms are governed by the law of the Republic of Slovenia. Courts in Slovenia have jurisdiction. If you are a consumer living elsewhere in the EU, you keep the protection of the mandatory laws and courts of your own country.

11. The rest

If any part of these terms is found invalid, the rest still applies and the invalid part is replaced by the closest valid wording. If we don't enforce a rule right away, we still keep the right to enforce it later. We may update these terms; the date at the top shows the current version, and using SPLAT KIT after a change means you accept it. These terms are the whole agreement between you and us about SPLAT KIT.
